REFUND, CANCELLATION, RETURN, TRANSFER AND RESCHEDULING POLICY

EFFECTIVE DATE: 21 SEPTEMBER 2026

 

 

1. ABOUT THIS POLICY

 

 

This Policy applies to purchases made from BE UNLIMITED LEARNING & COACHING (PTY) LTD, registration number 2025/252505/07, trading as BE UNLIMITED.

 

It applies to products and services offered, managed or delivered by BE UNLIMITED, including through any programme, initiative, platform, brand or offering operated by or on behalf of BE UNLIMITED.

 

This Policy applies to:

 Physical products and merchandise;

 Digital products and resources;

 Workshops, courses, trainings, events and other scheduled learning experiences;

 Coaching, facilitated programmes and other services; and

 Purchases made through our websites, registration forms, invoices, payment links or other channels.

 

In this Policy:

 

“we”, “us” and “our” refer to BE UNLIMITED LEARNING AND COACHING (PTY) LTD.

 

“Purchaser” means the person or organisation that makes and/or pays for the booking or purchase.

 

“Participant” means the person who attends, participates in or receives the relevant programme, event or service.

 

Where a participant is under 18 years of age, the booking must be made or authorised by a parent, legal guardian or another person legally authorised to consent on the participant’s behalf.

 

Where a booking includes more than one participant, each participant remains subject to the eligibility, registration and participation requirements applicable to the relevant offering.

 

Nothing in this Policy excludes, restricts or replaces any rights available to a consumer under the Consumer Protection Act, Electronic Communications and Transactions Act, or any other applicable South African law.

 

 

2. HOW TO REQUEST A CANCELLATION, REFUND, RETURN, TRANSFER OR RESCHEDULING

 

 

All requests must be submitted in writing to:

Please include:

 

 Your full name;

 Your order, invoice or booking reference, where applicable;

 The product, programme, event or service purchased;

 The participant’s name, where different from the purchaser;

 The date of purchase;

 The nature of your request; and

 Any relevant supporting information.

 

Submitting a request does not automatically guarantee a refund, transfer or rescheduling.

 

Each request will be assessed in accordance with this Policy and applicable consumer law.

 

 

3. PHYSICAL PRODUCTS AND MERCHANDISE

 

 

Physical products may include books, journals, printed resources, card decks, merchandise, clothing, gift items and other tangible goods.

 

3.1 Cancellation within 24 hours of purchase

 

You may request cancellation of a physical product order within 24 hours of purchase.

 

A full refund will ordinarily be provided where the product:

 

 Has not been dispatched or collected;

 Has not been personalised or produced specifically for you; and

 Has not otherwise entered the fulfilment process in a way that creates non-recoverable costs.

 

If the product has already been dispatched, produced to your specifications or made ready for collection, the request will be dealt with under the return provisions below and applicable consumer law.

 

3.2 Change-of-mind returns

 

Where a change-of-mind return is accepted, the product must generally be:

 

 Unused and undamaged;

 In its original condition;

 In its original packaging, where applicable; and

 Accompanied by proof of purchase.

 

Unless the product is defective, damaged or supplied incorrectly, the purchaser may be responsible for the direct cost of returning it.

 

Books, personalised products, custom-made products, opened software and certain other products may be excluded from statutory cooling-off rights where permitted by law.

 

3.3 Online purchases and statutory cooling-off rights

 

The 24-hour cancellation arrangement above is our standard voluntary cancellation period before fulfilment.

 

It does not limit any additional cooling-off or return right that may apply to a qualifying electronic transaction under applicable law.

 

Where a statutory cooling-off right applies, the return and refund will be handled in accordance with the applicable legislation, including any lawful exclusions and return-delivery costs.

 

3.4 Damaged, defective or incorrect products

 

Please notify us as soon as reasonably possible if a physical product is:

 

 Damaged when delivered;

 Defective or unsafe;

 Materially different from its description;

 Unsuitable for its ordinarily intended purpose; or

 Not the product ordered.

 

We may request photographs, proof of purchase or return of the product so that the matter can be assessed.

 

Where the product does not meet the standards required by applicable consumer law, the purchaser may be entitled to a repair, replacement or refund.

 

The cancellation provisions in this Policy do not limit statutory rights relating to defective, unsafe or incorrectly supplied products.

 

 

4. DIGITAL PRODUCTS AND RESOURCES

 

 

Digital products may include electronic books, downloadable guides, assessments, reports, templates, workbooks, recordings, online resources and other electronically supplied content.

 

4.1 Cancellation within 24 hours of purchase

 

You may request cancellation of a digital product order within 24 hours of purchase.

 

A full refund will ordinarily be provided only where the digital product has not been:

 

 Accessed;

 Downloaded;

 Opened;

 Streamed;

 Activated;

 Emailed or otherwise delivered; or

 Used to generate a personalised assessment, report or resource.

 

4.2 Digital products already supplied or accessed

 

Once a digital product has been accessed, downloaded, opened, streamed, activated or otherwise supplied, a change-of-mind refund may not be available, except where required by law.

 

Where a digital product is defective, inaccessible because of a fault on our side, materially different from its description or supplied incorrectly, we will first attempt to correct the problem or provide a replacement.

 

Where the problem cannot reasonably be corrected, an appropriate refund may be provided.

 

Where digital materials form part of a workshop, programme or service and have already been supplied before a cancellation, their reasonable value may be taken into account when determining any applicable cancellation charge, where permitted by law.

 

 

5. WORKSHOPS, EVENTS AND SCHEDULED EXPERIENCES

 

 

This section applies to workshops, seminars, conferences, facilitated group sessions, webinars, trainings and similar scheduled engagements, whether delivered online or in person.

 

5.1 Cancellation at least seven days before the scheduled date

 

A purchaser may request a full refund by cancelling in writing at least seven calendar days before the scheduled date.

 

Bookings made fewer than seven calendar days before the scheduled date are immediately subject to the late-cancellation provisions below.

 

5.2 Cancellation fewer than seven days before the scheduled date

 

Where a cancellation request is received fewer than seven calendar days before the scheduled date, we may deduct a reasonable cancellation charge.

 

The charge will be determined fairly, taking into account:

 

 The amount of notice provided;

 Materials or digital resources already prepared or supplied;

 Facilitator and service-provider commitments;

 Administrative and payment-processing costs;

 Venue, catering or other third-party commitments, where applicable;

 Reserved participant capacity;

 Other non-recoverable costs already incurred;

 The nature of the event or service;

 Whether the place can reasonably be filled; and

 Customary practice within the relevant sector.

 

Any refundable balance remaining after a reasonable cancellation charge has been deducted will be refunded.

 

5.3 Cancellations within 72 hours and non-attendance

 

Cancellations received within 72 hours of the scheduled start time, and failure to attend without prior notice, may result in no refundable balance where costs have already been incurred or the reserved place cannot reasonably be filled.

 

Where possible and subject to availability, we may offer a transfer to another suitable session instead of a refund.

 

Any cancellation charge will nevertheless be assessed fairly and in accordance with applicable consumer law.

 

5.4 Death, hospitalisation and exceptional circumstances

 

No cancellation charge will be imposed where the participant, or the person for whose benefit the booking was made, is unable to attend because of death or hospitalisation.

 

Serious illness, bereavement or other exceptional circumstances may be considered on a case-by-case basis.

 

We may request reasonable supporting information where appropriate.

 

 

6. TRANSFER TO ANOTHER PARTICIPANT

 

 

A participant transfer is different from a cancellation or refund.

 

A purchaser may request to transfer a booking to another qualifying participant up to 72 hours before the scheduled start time.

 

The following conditions apply:

 

 The transfer request must be submitted in writing;

 The replacement participant must meet the eligibility requirements for the relevant offering;

 Full registration information for the replacement participant must be provided;

 Where the replacement participant is under 18, the required parent or guardian consent must also be provided;

 The replacement participant and/or their parent or guardian must accept the applicable terms, and requirements;

 The transfer is valid only once confirmed by BE UNLIMITED in writing;

 he booking may not be resold at a profit; and

 No cash refund, credit or new payment entitlement is created merely because a transfer has been approved.

 

Once a transfer has been confirmed, the original participant may no longer use the booking.

 

The original payment will remain linked to the original purchaser for financial and refund purposes.

 

If BE UNLIMITED subsequently cancels the offering and a refund becomes payable, the refund will ordinarily be returned to the original payer using the original payment method.

 

Transfers may not be available for personalised services, individual coaching, assessments, customised programmes or services that have already commenced unless we approve the transfer in writing.

 

 

7. MULTIPLE-PARTICIPANT AND DISCOUNTED BOOKINGS

 

 

Where a booking includes more than one participant, a cancellation, transfer or rescheduling request may relate to one participant independently of the other participant(s), subject to availability and the conditions of this Policy.

 

Where a discount was granted because two or more participants were registered together, cancellation or transfer of one participant may affect the eligibility for that discount.

 

Where applicable, the remaining booking may be recalculated at the standard rate that would have applied had the remaining participant originally registered alone.

Any adjustment will be communicated before the cancellation or transfer is finalised.

 

 

8. RESCHEDULING TO ANOTHER DATE OR SESSION

 

 

A participant may request to move their booking to another available date or session.

 

Requests received at least 72 hours before the scheduled start time will ordinarily be considered subject to:

 

 Availability;

 The eligibility requirements of the alternative session;

 Any materials or resources already supplied;

 Administrative or third-party costs already incurred; and

 Any applicable price difference.

 

Approval of a session change is not automatic.

 

Where a date or session change is approved, the payment already made will be transferred to the new booking.

 

The participant will not be entitled to a refund merely because they later decide not to attend the rescheduled session.

 

Requests received fewer than 72 hours before the scheduled start time will ordinarily be dealt with under the late-cancellation provisions in this Policy.

 

 

9. TRAININGS, COACHING, PROGRAMMES AND OTHER SERVICES

 

 

This section applies primarily to multi-session programmes, coaching engagements, facilitated programmes and other services that extend beyond a single scheduled workshop or event.

 

9.1 Cancellation before commencement

 

A purchaser may request a full refund by cancelling in writing at least seven calendar days before the first scheduled session or programme commencement date.

 

9.2 Cancellation fewer than seven days before commencement

 

A cancellation received fewer than seven calendar days before commencement may be subject to a reasonable cancellation charge based on:

 

 Preparation already completed;

 Materials or digital resources already supplied;

 Facilitator or coach commitments;

 Reserved session time;

 Administrative and third-party costs; and

 Whether the place or session can reasonably be reassigned.

 

9.3 Cancellation after commencement

 

Where a programme or service has already commenced, we may deduct:

 

 The value of sessions or services already provided;

 The value of materials, assessments, reports or digital resources already supplied;

 Non-recoverable costs already incurred; and

 Any reasonable cancellation charge permitted by law.

 

Any refundable balance will be calculated and communicated to the purchaser.

 

Individual coaching sessions, personalised services, assessments and customised programmes are not transferable unless we agree otherwise in writing.

 

 

10. ONLINE DELIVERY AND TECHNICAL DIFFICULTIES

 

 

10.1 Participant-side connectivity or equipment problems

 

Participants are responsible for ensuring that they have:

 

 Suitable internet connectivity;

 A compatible device;

 Access to the required online platform; and

 Any other equipment or resources communicated before the session.

 

A refund will not ordinarily be provided where a participant is unable to attend or continue because of internet connectivity, power, device, software or other technical difficulties on the participant’s side.

 

Where a significant technical problem prevents a participant from continuing and the purchaser contacts us promptly, we may, where reasonably possible and subject to availability, offer transfer to another suitable session.

10.2 Technical failure on our side

Where a material technical failure on our side prevents delivery of a substantial part of an online session, we will take reasonable steps to remedy the problem.

 

Depending on the circumstances, we may:

 

 Resume or extend the session;

 Reschedule the affected portion;

 Offer another available session;

 Provide an appropriate credit; or

 Provide an appropriate full or partial refund.

 

 

11. CANCELLATION, POSTPONEMENT OR MATERIAL RESCHEDULING BY BE UNLIMITED

 

 

If we cancel an event, workshop, programme or service, the purchaser may choose to:

 

 Move the booking to another available event, programme or date;

 Transfer the booking to a suitable replacement participant;

 Receive a credit for an agreed future offering; or

 Receive a full refund of the amount paid.

 

If we postpone or materially reschedule an event, workshop, programme or service, the purchaser may choose to:

 

 Attend on the rescheduled date;

 Transfer to another available offering;

 Transfer the booking to a suitable replacement participant; or

 Request a full refund.

 

Where circumstances beyond our reasonable control prevent delivery, we will communicate with affected purchasers and participants as soon as reasonably possible and provide an appropriate transfer, credit, rescheduling or refund option.

 

Subject to applicable law, BE UNLIMITED is not responsible for personal travel, accommodation, connectivity, data or other indirect costs incurred in connection with an event, programme or service.

 

 

12. REFUND METHOD AND PROCESSING

 

 

Approved refunds will ordinarily:

 

 Be returned to the original payment method;

 Be paid to the original payer; and

 Be processed within 10 business days after approval or receipt of returned goods, where applicable.

 

A bank, card issuer or payment provider may require additional time before the funds appear in the purchaser’s account.

 

Card payments will not ordinarily be refunded in cash.

 

Where refunding the original payment method is not reasonably possible, we may require verification before approving an alternative arrangement.

 

All refunds will be processed within the period required by applicable law.

14. CHANGES TO THIS POLICY

 

 

We may update this Policy when our activities, programmes, systems, technology or legal obligations change.

 

The latest version will be published on our website with its effective date.
